POLICY
You are required to thoroughly review the terms and conditions of the retreat. Please carefully read what is included and excluded in your retreat package, and ensure you fully understand all aspects as outlined on our website. If you have any questions or require clarification on any terms and conditions, please don't hesitate to reach out to us. We are available for consultation and are happy to provide assistance before you finalize your contract with us.
PAYMENT TERMS & CANCELLATIONS
RETREAT PRICING
The prices listed are per person and are determined well ahead of the retreat's commencement. The prices cover the all-expenses paid retreat and does NOT include separate services offered.
RETREAT PAYMENT & DEPOSIT
Payment options include credit card or PayPal through our website. If a non-refundable deposit is submitted, the remaining balance must be settled no later than 4 weeks before the retreat begins. Participants will be sent a reminder email one week before the deadline. Failure to complete the full payment by this date grants us the right to cancel your reservation and offer your spot to another participant. We will endeavor to prevent this scenario by contacting you before and on the balance due date.
STRICT CANCELLATION POLICY
To cancel your retreat, you must inform Amy Castelluzzo ("The Host") via email at hello@earthhealshine.com. Please note that deposits are non-refundable, and no refunds will be issued after the payment deadline specified in section 2 above. Our cancellation policy does not allow for exceptions under any circumstances, including weather conditions, terrorism threats, civil unrest, health changes, personal emergencies, or any other reason. There will be no refund provided for arriving late or departing the trip early.
TRANSFER POLICY
Transferring reservations from one retreat to another is not permitted.
RETREAT CANCELLATIONS
The Host retains the right to implement necessary changes, including but not limited to advertised excursions, transportation arrangements, and meals. In the rare event of a retreat cancellation, The Host will either offer a transfer to another retreat (if available) or provide a full refund of your payment. Please note that The Host is not liable for any expenses or damages incurred due to retreat cancellation, including preparation costs, airline tickets, travel documents, or other expenses. Additionally, The Host reserves the right to cancel any retreat before departure if there are insufficient bookings, in which case you will receive a full refund of all payments made. It's important to understand that you are not entitled to claim additional amounts or seek compensation for any injury, loss, expenses, or damages (direct or consequential), or for any loss of time or inconvenience resulting from such cancellation, including visa, passport, and vaccination charges, gear purchases, airport and airline taxes, among others.
ROOMMATES
ROOMMATE ASSIGNMENTS
The rates for retreats are per person. Shared rooms, whether double or otherwise advertised, require shared occupancy at the specified room rate. If you reserve a shared room without indicating roommates, we'll make every effort to pair you with someone matching your preferences and price range. If we're unable to find a roommate for your initial choice, alternative rooming options will be presented. This means that in the absence of a roommate, you'll be responsible for the full cost of the room at the single room rate, rather than the shared rate.
ACKNOWLEDGEMENT
ASSUMPTION OF RISK
By voluntarily enrolling to participate in this retreat, I acknowledge and agree to release The Host from any claims, liability, and assume associated risks. This release of claims, waiver of liability, and assumption of risks extends to myself, my heirs, executors, successors, administrators, and any other interested parties. I waive any present or future claims that I or such parties may have. Furthermore, I release The Host, including any teachers, employees, guides, agents, or representatives (referred to as "the releasees"), from any liability for personal injury, death, property damage, or loss experienced by me during any retreat activity. This release extends to any cause, including negligence on the part of the releasees.
PHYSICAL TRAINING RELEASE OF LIABILITY
EXPRESS ASSUMPTION OF RISK
I, the undersigned, acknowledge the significant risks associated with physical training, including those inherent in yoga exercises, which may result in death, injury, or property damage. These risks encompass falls, negligence by oneself or others, equipment failure, strains, sprains, environmental factors, and actions of individuals. I assume full responsibility for these risks and any resulting injury or death, acknowledging that liability may arise from negligence, defective equipment, or other factors.
By willingly participating in these activities, I release The Host, their principals, teachers, agents, employees, and volunteers from any liability, claims, or actions related to my participation. This release extends to alleged negligent acts or omissions of the mentioned parties. This agreement is binding upon me and my successors.
In case of signing on behalf of a minor, I authorize individuals connected with the hosting organization to administer necessary first aid and seek medical care if needed.
I understand the need for indemnification, accepting financial responsibility for any injury caused due to my negligence. I agree to reimburse attorney's fees and costs incurred to enforce this agreement and indemnify The Host and the hosting organization from liability for injuries or damages resulting from my actions while participating in activities offered.
This indemnification extends to various locations selected for training, including parks, recreational areas, and playgrounds.
MEDIA
PERMISSION FOR CAPTURE AND USE
I hereby grant The Host absolute and irrevocable rights to any captured media, including photography, video, testimonials, or any likeness of me. This includes the right to use, reuse, publish, and republish such media in any manner and on any platform, for purposes such as illustration, promotion, editorial, advertising, and trade, without restriction as to alteration. I also authorize the use of my name in connection with any such use.
I release and discharge The Host from any claims or demands arising from the use of the media, including claims for libel or violation of rights of publicity or privacy. This authorization and release extend to the heirs, legal representatives, licensees, and assigns of the parties involved in capturing the media.
WAIVER
RELEASE AND WAIVER OF LIABILITY
As a legally competent adult, I have the right to enter into this contract. I have read and understood this document and agree to its terms. This release is binding upon me, my heirs, legal representatives, and assigns.
I agree that neither I nor any of my assignees, heirs, distributees, guardians, or legal representatives will hold The Host, their affiliates, teachers, employees, agents, or volunteers liable for any injury or damage resulting from my participation in The Host's retreats. This release extends to acts by any employee, agent, or contractor of The Host or their affiliated organizations.
I release The Host, along with their agents or affiliated organizations, from any present or future actions, claims, or demands for injury, damage, or death resulting from my participation in their retreats.
I affirm that I am medically, physically, emotionally, and in all respects fit to participate in The Host's retreats. I acknowledge my responsibility for my own physical condition and well-being during the retreat, agreeing to follow safety precautions and instructions provided by The Host.
While The Host may offer suggestions for my well-being, I understand that I bear ultimate responsibility for my choices. I acknowledge that The Host is not a licensed medical provider and that I should consult my doctor as needed.
Should I experience any pain or discomfort during the retreat, I will adjust The Host's instructions to suit my individual needs and will not hold The Host responsible for any resulting discomfort. I understand that the activities offered on this retreat are not a substitute for medical care.
By agreeing to the terms outlined on The Host's website and in this agreement, I waive any rights and claims for damages or liabilities that may arise from my participation in The Host's retreats.
Policy
- Guests must sign a waiver upon registering for the retreat.
- All information and or experiences shared during the retreat will be kept strictly confidential.
- Photos will only be used after permission is granted.
- Cancellations must be made within one week of the scheduled retreat via a phone call or email to the Host (Amy - 845-594-1254 or hello@earthhealshine.com)
- Guests are encouraged to meet at the designated location in NYC for a stress-free, fully insured ride in the 15-passenger luxury van.
- Guests should not apply or bring any commercial perfumes/ fragrances to the retreat. However, essential oils are welcome!
- All accommodations are shared with the exception of the single, if available.
- Guests should bring the following:
- Yoga mat
- Sunscreen
- Sun hat
- Bathing suit
- Chemical free insect repellent
- Cell phones must be turned off during all retreat activities.
